This case concerns allegations of a racially discriminatory work environment within the Detroit Police Department (“DPD”). On August 23, 2018, a Black DPD officer sued the City of Detroit (“City”), the DPD, the DPD Chief, five DPD officers, and twenty City employees in the U.S. District Court for the Eastern District of Michigan. Represented by the ACLU of Michigan, the plaintiff sued under Title VII of the Civil Rights Act of 1964, 42 U.S.C. §§ 1981 and 1983, and Michigan state law. The complaint alleged that the DPD created a racially hostile work environment in violation of Title VII, with a pattern of white officers discriminating against and harassing Black subordinates. The plaintiff further alleged that when he inadvertently entered a suspected crime scene while off-duty on January 22, 2017, white DPD officers violated the Fourth Amendment by unreasonably detaining him and searching his car without probable cause. After he filed an internal complaint, other officers filed Internal Affairs charges against him. The plaintiff contended that these baseless allegations constituted retaliation under Title VII. The complaint further alleged that the DPD’s racially discriminatory workplace violated Michigan state law and 42 U.S.C. § 1981 by depriving the plaintiff of his civil rights. The plaintiff sought compensatory and punitive damages, injunctive relief, and attorneys’ fees and costs. The case was assigned to District Judge Nancy G. Edmunds.

Judge Edmunds dismissed the Michigan state law claims on September 17, 2018. The parties agreed to dismiss the DPD as a defendant, and the court did so on October 9, 2018. The plaintiff filed an amended complaint on November 20, 2018, which removed the DPD as a defendant but did not add any new parties. The defendants moved for summary judgment on July 11, 2019.


The court granted summary judgment for the defendants on November 5, 2019. On the Title VII claims, Judge Edmunds held that the plaintiff did not present direct evidence of racial causation for the January 22 incident, the plaintiff’s testimony on a racist DPD culture was too vague to defeat summary judgment, and the DPD had a legitimate non-retaliatory reason for disciplining the plaintiff. The court dismissed the Fourth Amendment claims, finding that the officers deserved qualified immunity because their conduct on January 22 was reasonable. The court also held that the City and the Chief were not liable for individual officers’ conduct on January 22. Finally, the court granted summary judgment on the § 1981 claims, holding that the § 1981 cause of action did not extend to suits brought against state actors in the Sixth Circuit. 

The plaintiff appealed on November 25, 2019. U.S. Court of Appeals for the Sixth Circuit Judges Eric L. Clay, Julia Smith Gibbons, and John B. Nalbandian heard oral arguments on October 23, 2020. 

On April 22, 2021, the Sixth Circuit affirmed summary judgment for the defendants on the Title VII hostile work environment claim, but reversed on the Fourth Amendment excessive force and Title VII retaliation claims. Writing for the court, Judge Clay held that the plaintiff did not provide enough evidence of severe, pervasive, and frequent harassment to survive summary judgment on the hostile work environment claim. However, the plaintiff did provide enough evidence that his discipline was pretextual to defeat summary judgment on the retaliation claim—he demonstrated that another officer committed the same infraction he did, but was not disciplined. The court also held that the DPD officers did not deserve qualified immunity for their actions on January 22, and thus reversed summary judgment on the Fourth Amendment excessive force claim. Judge Clay held that a genuine dispute of material fact existed as to whether the DPD officer ignored the plaintiff’s complaint that the handcuffs were too tight. Judge Nalbandian dissented with respect to the Title VII retaliation claim.

The case proceeded to trial, held before a jury from December 1 to December 5, 2022. The defendants moved for a directed verdict on December 2, 2022 which the court denied on December 21. The court entered judgment for the plaintiff on December 12, 2022, in the amount of $150,001.00. The jury awarded $1 on the excessive force claim and $150,000 on the retaliation claim.

The plaintiffs moved for attorneys’ fees and costs on January 18, 2023. On the same day, the defendants moved for judgment as a matter of law and/or for a new trial. The court denied the defendants’ motion on November 28, 2023. Judge Edmunds held that a reasonable jury could find the plaintiff’s explanation of retaliation and evidence of excessive force credible. The court also held that the defendants’ change in trial strategy did not entitle them to a new trial. 

On December 20, 2023, the City filed a notice to appeal the district court’s denial of its renewed motion for judgment as a matter of law or a new trial. On December 27, 2023, Judge Edmunds issued an order granting in part plaintiff’s motion for attorneys’ fees, costs, and expenses. The court awarded attorneys’ fees in the amount of $204,790.12 and costs and expenses in the amount of $8,295.04.

The City filed a motion to stay all proceedings on January 12, 2024, asking the court to delay the award to the plaintiffs until the appeal with Sixth Circuit concluded. The plaintiff responded that he did not intend to enforce the order granting costs, fees, and expenses until the conclusion of the appeal, so the district court denied the City’s motion to stay on April 24, 2024, concluding that it was unnecessary. 

On November 6, 2024, the Sixth Circuit issued its opinion affirming the district court’s decision. The panel determined that the plaintiff had presented enough evidence for the jury to find that the City retaliated against him for filing his EEO complaint, that the jury reasonably concluded that excessive force was used against the plaintiff when he was handcuffed, and that district court did not err when conducting the trial. On December 10, 2024, Judge Edmunds issued a stipulated order extending the time to file a motion for post-appeal attorneys’ fees. As of December 30, 2024, this case is ongoing.
