Case Summary

On January 12, 2025 American Alliance for Equal Rights filed suit against McDonald’s Corporation in the Middle District of Tennessee, alleging that the company’s HACER program was racially discriminatory against non-Hispanic individuals. Plaintiff was represented by private counsel. McDonald’s HACER program awarded thousands of dollars in scholarships to 30 Hispanic students nationwide. Plaintiffs alleged that the program violated §1981 of Title VI, which prohibits companies from discriminating based on ethnicity when making contracts. The case was assigned to Judge William L. Campbell who referred it to Magistrate Judge Jeffery S. Frensley. 

On January 31, 2025, the parties settled the case, with McDonald's agreeing to open the HACER scholarship to all applicants regardless of race or ethnicity. 

The case was dismissed with prejudice on February 3, 2025 and is now closed.
