Case Summary

This case concerns allegations of age discrimination against employees of IKEA. On February 21, 2019, the Plaintiff, a 48 year old long term employee of IKEA, filed this lawsuit in the Eastern District of Pennsylvania on behalf of himself and “all those current and former employees of IKEA in the United States who, since January 24, 2018, were age 40 or over and denied promotion.” The Plaintiff sued IKEA under the Age Discrimination in Employment Act (ADEA),  29 U.S.C §621. Specifically, Plaintiff brought two claims of age discrimination under the ADEA: a disparate treatment claim and a disparate impact and promotion rates claim. In his complaint, Plaintiff alleged that IKEA promoted four young employees for a position it previously denied the Plaintiff, though Plaintiff previously filled the position on an interim basis. Several months later, IKEA allegedly demoted the Plaintiff to a position that paid $10 less per hour. They claimed that IKEA has openly expressed preference in favor of younger employees over older employees and has a corporate culture of age discrimination. Represented by private counsel, the Plaintiff sought injunctive and declaratory relief, compensatory and liquidated damages, and attorney’s fees and costs. The case was assigned to District Judge Anita B. Brody.

On April 30, 2019, IKEA filed a motion to dismiss for failure to state a claim. The court denied the motion to dismiss because Plaintiff amended their complaint.

On May 21, 2019, the Plaintiff filed a First Amended Complaint. The complaint added a cause of action under the Connecticut Human Rights and Opportunities Act and its subsection, the Connecticut Fair Employment Practices Act. The claim of age discrimination in violation of the Connecticut Fair Employment Practices Act was brought by the Plaintiff on an individual basis only.

On June 4, 2019, IKEA filed a partial motion to dismiss the First Amended Complaint. IKEA moved to dismiss the ADEA disparate impact claim for failure to state a claim, claiming that the the policies identified in the Plaintiff’s complaint were not specific enough to support the claim. IKEA contended that Plaintiff failed to demonstrate that IKEA’s policies were facially neutral because he alleged the same policies were sources of intentional discrimination. Judge Anita B. Brody granted in part and denied in part IKEA’s partial motion to dismiss on January 23, 2020. Specifically, Judge Anita B. Brody granted the motion to dismiss for three policies, the Leadership Development Policy, Screening Interview Policy, and Diversity Policy, and denied the motion for two policies, the Potential Policy and Relocation Policy. 2020 WL 374581.

On February 5, 2020, the Plaintiff filed a Second Amended Complaint. The complaint added information about charges of discrimination with the Equal Employment Opportunity Commission filed by the Plaintiff, and attached additional exhibits of the filings.

On March 1, 2021, the case was referred to District Judge David Strawbridge for settlement. IKEA filed a motion to vacate the order referring the case to settlement, which Judge Brody denied on March 15, 2021.

For the next three years, the parties engaged in discovery. On June 3, 2024, IKEA filed a motion for summary judgment. The Plaintiff also filed a motion for partial summary judgment and equitable relief, requesting the court grant summary judgment on the disparate treatment claim under the ADEA. The court ordered the case be referred to mediation on October 10, 2024.

On August 6, 2025, the parties reached a settlement. The settlement was a part of a private settlement agreement that settled four other age discrimination lawsuits against IKEA.

As a result of the settlement, Judge Anita B. Brody dismissed the case on August 6, 2025.
