In September 1999, the Charlotte District Office of the EEOC brought this suit against BASF Corporation in the U.S. District Court for the Western District of North Carolina alleging discrimination on the basis of sex in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant failed to hire the charging party, a female applicant, for the position of Chemical Operator because of her sex. After some scheduling orders, the parties settled through a consent decree in November 2000.

The two-year decree, containing non-discrimination and non-retaliation clauses, required the defendant to: expunge the charging party's personnel file of all references to the charge of discrimination, post an employee notice, distribute its anti-discrimination policy, provide Title VII training for all its employees, report to the EEOC at specified intervals, and pay $12,500 to the charging party.
