The Chicago District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Illinois, against United Airlines, Inc., an international airline. The complaint, filed in February 2003, alleged disability discrimination in violation of the Americans with Disabilities Act of 1990 (ADA); specifically that Defendant had discriminated and retaliated against the charging party when it failed provide a reasonable accommodation for him.
In April 2004 a consent decree was entered that was valid for 2 years. The decree prohibited Defendant from discriminating against employees or applicants based on disability and failing to make a reasonable accommodation for any qualified employee or applicant with a disability. Defendant was required to pay the charging party $200,000 in damages (subject to Defendant's bankruptcy proceedings), keep the charging party in Extended Illness Status until she was eligible to retire, post and distribute a notice of non-discrimination at its facility, provide employment discrimination training, and maintain records of any complaints of disability discrimination or failure to accommodate from employees or applicants.
