Case Summary

In June 1999, the EEOC district office in Miami, Florida brought this action against Associated Home Health Care of Palm Beach, a division of Marshal Medical Services, Inc., in the U.S. District Court for the Southern District of Florida. The complaint alleged that the defendant violated the Americans with Disabilities Act of 1990 when it refused to accommodate an employee's disability and subsequently discharged her.

After the case was referred to mediation, the parties settled and a consent decree was entered. The defendant agreed to pay the aggrieved party $10,000, refrain from retaliating and discriminating on the basis of diability, distribute a copy of its ADA policy to all its staff, provide its managers and supervisors with two hours of EEO training, post an EEO notice, and submit semiannual complaint/compliance reports to the EEOC. The terms of the agreement ran for four years.
