The EEOC's Los Angeles district office sued Vulcan Materials Company, d/b/a Calmat Company, on April 18, 2000 in the U.S. District Court for the Southern District of California. The EEOC's complaint alleged that the defendant violated Title VII when it discriminated based on sex (female) by failing to hire a female driver because of her sex. The EEOC filed a motion for partial summary judgment against the defendant's affirmative defenses in April 2001, which was denied in May. In response, the defendant filed a motion for summary judgment or, alternatively for summary adjudication of the issues, which was granted as to one of the EEOC's claims. The parties subsequently entered into a consent decree on July 31, 2001, which stipulated that the defendant would pay the complainant $34,000 in damages, post a notice of available driving jobs, provide Title VII training for its managers and human relations personnel (which the EEOC may attend), and retain records of employment decisions for driver positions.
