In July 2001, the EEOC district office in San Antonio, Texas brought this suit against Austin Commercial, Inc. in the U.S. District Court for the Western District of Texas. The complaint alleged that the defendant perpetuated a racially hostile work environment in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complainant alleged that a black employee was subjected to to racial graffiti, drawings of nooses with his name next to them, and invitations to Ku Klux Klan meetings by White co-workers. Two months after the defendant filed its initial answer with the court, the parties settled in December of 2001. No documentation of the settlement is available.
