EEOC's Phoenix, AZ office filed this Title VII lawsuit based on religion. The defendant was a foreign corporation named Sanmina-SCI Corporation. The defendant operated an electronics manufacturing plant in Phoenix, AZ. The lawsuit was filed at the United States District Court for the District of Arizona (Phoenix) on 09/23/2004.

EEOC alleged on behalf of a former employee that he was not rehired after layoff because of his religion, Sikh, which required him to carry a knife while at work. The individual complainant did not intervene in the lawsuit or file a separate suit.

The district court scheduled a settlement conference for the parties initially but cancelled it later. Thereafter, the defendant moved for summary judgment. District Judge Earl H. Carroll granted the summary judgment motion, holding that the allegation of the effect of a discriminatory act should be dismissed when the allegation of the act is time-barred even though the allegation of the effect of the act is not.

After the dismissal of the case, the defendant moved for sanctions against EEOC and EEOC appealed to the Ninth Circuit regarding the summary judgment. When the defendant later withdrew the sanction motion, EEOC also voluntarily dismissed the appeal.
