Case Summary

In September 1999, the Phoenix Office of the EEOC brought this lawsuit against Autonation USA Corporation in the U.S. District Court for the District of Arizona. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the 9th Circuit appellate decision that the complaint alleged the defendant discriminated against the charging party on the basis of religion, Christianity, in violation of Title VII of the Civil Rights Act of 196…

In September 1999, the Phoenix Office of the EEOC brought this lawsuit against Autonation USA Corporation in the U.S. District Court for the District of Arizona. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the 9th Circuit appellate decision that the complaint alleged the defendant discriminated against the charging party on the basis of religion, Christianity, in violation of Title VII of the Civil Rights Act of 1964 by failing to reasonably accommodate complainant's wish not to work on Sundays. Following discovery, the defendant moved for summary judgment in April 2001, which was granted in July 2001. The EEOC appealed in September 2001 to the 9th Circuit Court of Appeals, which was accepted November 2001 as docket number 01-17064. The 9th Circuit affirmed the District Court's grant of summary judgment in this case, with Circuit Judge Paez dissenting and filing an opinion. The non-citable case may be found at E.E.O.C. v.
