The Atlanta District Office of the EEOC brought this Title VII suit against Gammans Architectural (doing business as Skyline International, Inc.) and Gammans Architectural Products in September 2005 in the U.S. District Court for the Northern District of Georgia. The complaint, filed on September 30, 2005, alleged that complainants were terminated because of their race. More specifically, the complainants alleged that the defendant terminated the complainants (the two most tenured and experienced employees at their position) while retaining less tenured and experienced non-Black employees and hiring less qualified non-Black employees to share in the duties and responsibilities previously held by the complainants.

On April 28, 2006, Judge Clarence Cooper granted the plaintiff's motion for default judgement. In this order, he granted several types of relief. He granted a permanent injunction for the defendants to not discriminate based on race. He also required that the defendants implement equal employment policies, practices and programs. The defendants were to reinstate the plaintiffs without loss of seniority, and they were to pay them compensatory relief. This order then referred the matter to Magistrate Judge Janet King for an evidentiary hearing on damages and to determine if the defendants intentionally or with malice carried out their discrimination.

On June 26, 2006, Magistrate Judge King oversaw the evidentiary hearing. After the hearing, Magistrate Judge King filed a final report and recommendation on July 20, 2006. She recommended to Judge Cooper that pay compensatory damages, but not reinstatement. Following this report, Judge Cooper ordered the adoption of this recommendation. Judge Cooper also ordered a default judgment on in favor of the EEOC on October 26, 2006, for the permanent injunction.

As a result of the default judgment, the court ordered the defendant to pay one complainant $77,484.18, consisting of $42,484.18 in back pay and $35,000 in compensatory damages. The court also ordered the defendant to pay the other complainant $85,124.15, consisting of $50,124.15 in back pay and $35,000 in compensatory damages. The default judgment also permanently enjoined the defendant from engaging in discriminatory practices.

The EEOC filed a motion for a writ of execution and attorneys' fees and costs on August 31, 2007. It followed up with the application for writ of execution on September 4, 2007. By November that year, the complainants were added to the case as plaintiffs. The parties engaged in post-judgment discovery after that. During that time, on April 16, 2008, the EEOC withdrew its motion and application for writ of execution. Discovery continued through August 2008.

It's not clear from the docket what happened between August 2008 and the beginning of 2010. On March 10, 2010, because the complainants were still owed money, the EEOC moved to amend the October 2006 default judgment in order to add the former owner of Gammans Architectural Products and the former president of Skylights International. They had closed their respective businesses as a result of this lawsuit, but the former owner of Gammans Architectural Products owned a different company, Sol-Area, that hired employees from the closing businesses. On March 24, 2010, the two individuals—the former owner of Gammans Architectural Products and the former president of Skylights International—moved to intervene. Judge Cooper denied the motion to amend but granted the motion to intervene on November 23, 2010.

On August 26, 2013, a financial institution that was the assignee of the complainants moved to substitute Sol-Area for the defendants. The complainants also filed an application for a writ of execution on August 30.

The assignee for the complainants filed an emergency motion on October 23, 2013, for issuance of a renewed writ of execution. On October 25, 2013, Judge Cooper denied both the motion for substitution and the emergency motion for a renewed writ because the assignee lacked standing to enforce the judgment.

This case is closed.
