The Seattle District Office of the EEOC brought this Title VII suit against Laidlaw Inc., a school bus company, in March 2002, in the United States District Court for the Western District of Washington. The complaint alleged that the defendant discriminated against her because of sex. The complainant intervened in the suit in May 2002 adding causes of action under the Washington Law Against Discrimination and state tort law. The defendant moved for summary judgment, which was granted in part and denied in part. The sex discrimination claims were allowed to proceed, but Judge Thomas Zilly dismissed the claims related to negligent infliction of emotional distress and negligent hiring and retention.

The case went to trial in June 2003 and the court issued a judgment in favor of the plaintiff on claims under federal and state law, but for the defendant on the issues of punitive and injunctive relief. The court ordered an amended judgment a year later that required the defendant to offset adverse tax consequences of the damages, which were $3,029.78 in economic damages and $30,000 in non-economic damages. All parties filed notices of appeals in September 2004, but dismissed the appeals in October 2004.
