In September 1999 the Birmingham, AL and Jackson, MS offices of the EEOC brought this suit against Royer Homes of Mississippi, Inc. in the U.S. District Court for the Southern District of Mississippi. The EEOC alleged that the company discriminated against a female charging party by denying her promotions on the basis of her gender and retaliated against her by demanding that she release a viable Title VII claim before the company would pay her for work already performed. The private plaintiff …

In September 1999 the Birmingham, AL and Jackson, MS offices of the EEOC brought this suit against Royer Homes of Mississippi, Inc. in the U.S. District Court for the Southern District of Mississippi. The EEOC alleged that the company discriminated against a female charging party by denying her promotions on the basis of her gender and retaliated against her by demanding that she release a viable Title VII claim before the company would pay her for work already performed. The private plaintiff intervened in the case in August 2000.

The defendant filed a motion for summary judgment in February 2001, which was denied in June 2001. The case went to trial in June 2001. After the trial, the jury returned a verdict for Royer Homes on the discrimination claim but for the plaintiff on the retaliation claim, awarding $75,000 in damages. The defendant appealed the judgment, but the 5th Circuit affirmed the district court's decision. On January 15, 2009, the court granted plaintiff's motion to revive judgment but denied her motion for entry of default judgment; it also ordered the defendant to pay $139,168.68 to plaintiff, with an additional daily fee until judgment was satisfied.
