The Dallas District Office of the EEOC brought this suit against Groom & Sons Hardware & Lumber, Inc., in September of 2002, in the U.S. District Court for the Northern District of Texas. The EEOC alleged that Groom & Sons discriminated against a female employee, in violation of Title VII, when they discharged her due to her pregnancy. The case was ultimately settled and a consent decree was entered into on February 2nd, 2004.
In the consent decree Groom & Sons agreed to pay $15,000 to the complainant as well as comply with certain injunctive relief. This injunctive relief consisted of reinstatement for the complainant, a neutral reference if she decides not to stay employed there, a prohibition from future discrimination on sex or pregnancy, EEO training, and posting of rights to all employees. The decree is in effect for two years and the plaintiffs can seek court enforcement of its provisions if there is non-compliance.
