The Atlanta District Office of the EEOC brought this action in the U.S. District Court for the Northern District of Geogia, against BellSouth Telecommunications, a national telephone and internet provider. The complaint filed in September 2005 alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, BellSouth failed to promote the plaintiff to sales coach despite her tenure, experience and proven performance, and instead, promoted less qualified non-black employees. In August 2006, the parties settled and a consent decree was filed.

The Consent Decree was valid for 18 months and included (1) a non-retaliation provision; (2) a provision requiring that Defendant hold at least one Title VII training session for managers and supervisors; (3) a provision regularly requiring Defendant to certify whether any African American employees had complained to management about denial of a promotion because of race and (4) a provision requiring the Defendant to post a notice containing information about federal anti-discrimination law. Additionally, Defendant paid the charging party $26,700. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
