The San Francisco District Office of the EEOC brought this action in the U.S. District Court for the Eastern District of California, against AGI Publishing Inc., d/b/a Valley Yellow Pages. The complaint, filed in September 2003, is not available to us. As found in the settlement agreement, the complaint specifically alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964; stating that Defendant subjected the charging party to a sexually hostile and offense working environment.
In February 2004, after discovery, the parties settled and a settlement agreement was signed six days later. The agreement provides that Defendant would, within thirty days of the agreement, adopt the proposed changes to its employee handbook, and the EEOC would file a Dismissal with Prejudice of the litigation.
