The Miami District Office of the EEOC brought this suit against AA Precast Inc., in September of 2000, in the U.S. District Court for the Middle District of Florida. The suit alleged a practice of discrimination based on gender in the hiring of female employees for a laborer position. In particular one female who applied and was given the job had the job taken away because the company said they had never employed a woman as a laborer and it was very physical work, which they concluded she could not perform. The suit was short lived and in just over a year after the complaint was filed, the two parties settled the case.
The settlement included both monetary relief and injunctive relief. The particular complainant received $10,000 in backpay and frontpay. AA Precast was also then prohibited from further discrimination based on gender. They were required to develop and anti-discrimination policy and train their managers and human resource personal every year. In addition the company was to post their anti-discrimination policy in both their employee handbook and in a common place at their facilities. They were required to take out advertisements in a local newspaper to promote female applications. AA Precast was also required to make biannual reports to the EEOC regarding their hiring and rejections of female applicants for the laborer position at their company.
