In September 2003, the Los Angeles District Office of the EEOC filed this suit against Peppermill Hotel & Casino in the U.S. District Court for the District of Nevada alleging discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant refused to hire the charging party, a Black applicant, because of her race. In addition, the defendant failed to retain employment records as required by federal law. A proposed consent decree was filed on the same day as the complaint, and the case settled merely six days later.

Under the terms of the eighteen-month consent decree, the defendant agreed to pay the charging party $5,000. In addition, the decree required the defendant to maintain employment applications and resumes as required by federal law and to keep records of all complaints of discrimination. The defendant was also required to allow the EEOC to inspect its premises, copy documents, and interview employees in order to inspect its compliance with the decree.
