Case Summary

On September 28, 2005, the Atlanta and Charlotte offices of the Equal Employment Opportunity Commission filed a lawsuit under Title VII against Regency Health Associates in the U.S. District Court for the Northern District of Georgia. The EEOC alleged that the defendants had violated the rights of the complainant by constructively discharging her when she insisted on wearing a head scarf for religious reasons in violation of their uniform policy.On August 18, 2006, the defendants filed a motio…

On September 28, 2005, the Atlanta and Charlotte offices of the Equal Employment Opportunity Commission filed a lawsuit under Title VII against Regency Health Associates in the U.S. District Court for the Northern District of Georgia. The EEOC alleged that the defendants had violated the rights of the complainant by constructively discharging her when she insisted on wearing a head scarf for religious reasons in violation of their uniform policy.

On August 18, 2006, the defendants filed a motion to dismiss for lack of subject matter jurisdiction, but that motion was later withdrawn. On August 21, 2006, the defendants filed a motion for summary judgment, but they later withdrew that motion on October 30, 2006.

The jury trial began on July 30, 2007, and it ended on August 1, 2007, with the jury returning a verdict for the defendant. The EEOC appealed this ruling, and on February 8, 2008, the U.S. Court of Appeals for the Eleventh Circuit dismissed the appeal.
