In June 2002, the Milwaukee (along with the Washington, D.C.) office of the EEOC brought this ADA suit against Remedy Intelligent Staffing in the U.S. District Court for the Southern District of Iowa. The complaint alleged that the defendant discriminated against the claimant by refusing to hire the claimant because the claimant was deaf. In June 2002, the Milwaukee (along with the Washington, D.C.) office of the EEOC brought this ADA suit against Remedy Intelligent Staffing in the U.S. District Court for the Southern District of Iowa. The complaint alleged that the defendant discriminated against the claimant by refusing to hire the claimant because the claimant was deaf. The claimant intervened in the EEOC's suit in November 2002. Both the EEOC and the claimant filed partial motions for summary judgment in October 2003 that were denied in December. The case settled by entry of a consent decree in February 2004.

The two year consent decree required the defendant to pay the claimant $80,000 in damages and attorney's fees, post and distribute notice, provide training for managers and supervisors, keep written records on disabled applicants, give semiannual reports to the EEOC on disabled applicants going through the application process, allow the EEOC review relevant documents to measure compliance, and refrain from discrimination.
