The San Antonio District Office brought this action in the U.S District Court for the Northern District of Texas, against Brownfield Motorplex, Inc. The complaint, filed in March 2005, alleged age discrimination in violation of the Age Discrimination in Employment Act. Specifically, the complaint alleged that the Defendant discharged the charging party because of his age.

In March 2006 a consent decree was entered and it was signed by the judge 5 days later. The decree, which was good for 3 years, provided for the Defendant to pay the charging party $23,750; post a notice regarding its non-discrimination policy; distribute said notice and require its employees to sign and return an acknowledgement that they received the notice; and provide 4 hours of non-discrimination training to its management employees. During the duration of the decree, if the court determines that the decree was violation, the 3 year period shall recommence and continue from the date of the violation. The docket sheet does not show any further enforcement; the case was presumably closed in 2009.
