EEOC's Philadelphia, PA office and the U.S. Attorney's Office in Delaware jointly filed this ADA lawsuit against the defendant Citibank Delaware in the United States District Court for the District of Delaware (Wilmington) on 05/31/2005. The complaint alleged that a former employee at defendant's New Castle, DE facility was subject to retaliatory discharge for her Sickle Cell Anemia and related diseases. It was also alleged that the defendant failed to accommodate the complainant's need for medical leave when she was hospitalized for an outbreak of the disease. The complainant did not intervene in the lawsuit or file a separate lawsuit.The parties spent the initial several months trying to figure out the right defendant to sue. It turns out that EEOC got the defendant wrong initially. EEOC corrected the defendant's name in an amended complaint. Thereafter, the parties engaged in some discoveries and then settled the case. A consent decree was entered on 09/28/2006.Under the consent decree lasting 18 months, the defendant agreed to pay the complainant $37,500. The defendant would also post EEO notice for one year. Because the defendant certified that it already provided training earlier that year, no additional training was required. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
