Case Summary

In May 2001, the EEOC district office in San Antonio, Texas brought this suit against the Union Pacific Corporation, a national freight carrier, in the U.S. District Court for the Western District of Texas. The suit alleged that defendant violated Title VII of the Civil Rights Act of 1964 when it denied a promotion to a black employee because of his race.

After the charging party intervened, a consent decree was entered in March 2002. The parties agreed that the defendant would pay the complainant $250,000, continue to provide EEO training to all supervisors and staff, refrain from retaliating and discriminating on the basis of race, mail copies of its EEO policy and EEO rights to employees, and allow the EEOC to conduct inspections. No fees or costs were awarded. The terms of the agreement ran for two years.
