The New York District Office of the EEOC brought this action in the U.S. District Court for the Northern District of New York, against Labor Ready. The complaint, filed in May 2005, alleged sex discrimination in violation of Title VII of the Civil Rights Act of 1964, specifically that Defendant did not promote charging party because of her sex, female.
In February 2006 the parties proposed a consent decree and one week later it was signed. The decree was valid for two years and required Defendant to pay the charging party a total of $38,100 ($18,750 for compensatory damages, $18,750 for back pay and $600 for a consultation with counsel). Defendant was enjoined from discriminating or retaliating in violation of Title VII and required to post a notice of non-discrimination, provide EEO training to its employees, and utilize an anti-discrimination policy. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
