On August 23, 2005, the Memphis office of the Equal Employment Opportunity Commission filed a lawsuit under Title VII against Hill Boren, P.C. in the U.S. District Court for the Western District of Tennessee. The EEOC alleged that the defendants had violated the rights of the complainant by subjecting her to sexual harassment in the workplace, creating a hostile work environment and leading to her discharge.
On February 16, 2006, the court granted the complainant's motion to intervene as a party plaintiff in the case. On July 23, 2007, the parties entered a settlement agreement and filed it with the court. Under the terms of the agreement, the defendants agreed to pay $15,000.00 in unspecified damages to the plaintiff-intervenor in this case. The parties agreed to bear their own attorneys' fees and costs. Within sixty days of the entry of the settlement agreement, the defendants agreed to provide at least two hours of sexual harassment awareness training to all management officials and employees at the Memphis location. The training was to be administered by an outside party. In addition, the defendants agreed to post notice of their equal employment opportunity policy in a conspicuous place in their facility, and to require all employees and management personnel to read the policy and sign an acknowledgment that they read it. The settlement agreement was to remain in effect for two years. The docket sheet does not show any further enforcement; the case was presumably closed in 2009.
