The case was assigned to Judge S. James Otero.

In settlement of this lawsuit, the parties entered a consent decree on March 14, 2008, which became effective on March 17, 2008. Here, the defendant agreed (1) to pay $120,000 to the complainant and $5,000 to another female employee, (2) not to harass or discriminate based on sex and not to retaliate, (3) to post an anti-harassment notice to its employees, (4) to retain Equal Employment Opportunity Consultant to monitor the defendant’s compliance with Title VII and the consent decree, (5) to develop anti-sexual harassment policy, (6) provide training for its employees, (6) revise performance evaluations of supervisory employees to reflect new anti-discrimination policies, (7) to collect, investigate and resolve all discrimination complaints, (8) to provide equal employment opportunities for the named complainants, and (8) to maintain relevant record and report to the EEOC.

The three-year duration of the consent decree had expired, and no updates were shown on the docket. The case was closed.

CONSENT DECREE: In settlement of this lawsuit, defendants shall pay a total of $120,000 to Maria Jaurequi and $5,000 to Petra Flores to resolve this action. Defendant shall deliver via federal express [or other delivery service with trackin g], a check in the amount of $120,00 to Ms. Jaurequi and a check in the amount of $5,00 to Ms. Flores within twenty (20) days to the effective dated of this decree. Defendant shall also prepare and deliver to each Ms. Jaurequi and Ms. Flore s a IRS Form 1099 tax reporting form with each settlement check.
