Case Summary

In August 2003, the EEOC district office in Chicago, Illinois brought this suit against Caterpillar, Inc., a national construction equipment manufacturer, in the U.S. District Court for the Northern District of Illinois. Three black males intervened in the suit. The complaint states that the aggrieved men asserted claims of racial discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the men claimed that coworkers would harass and whistle at them as if they were dogs. When the men complained, the defendant did nothing. Still, after extensive discovery, failed motions for summary judgment, and a jury trial, the defendant prevailed in October 2004. The EEOC filed a notice of appeal, but the case was dismissed at the circuit level in February 2005.
