The Baltimore Field Office of the EEOC brought this suit against Warfield-Rohl Casket Company, Inc., which manufactures caskets, in September 2001, in the U.S. District Court for the District of Maryland. The suit alleged that the complainant, a 56 year old male, was fired from his job as a foreman at the company's trimming division because of his age in violation of the Age Discrimination in Employment Act. The defendant filed a motion for summary judgment, which was granted, before the case…

The Baltimore Field Office of the EEOC brought this suit against Warfield-Rohl Casket Company, Inc., which manufactures caskets, in September 2001, in the U.S. District Court for the District of Maryland. The suit alleged that the complainant, a 56 year old male, was fired from his job as a foreman at the company's trimming division because of his age in violation of the Age Discrimination in Employment Act. The defendant filed a motion for summary judgment, which was granted, before the case went to trial. The EEOC appealed the decision to the Fourth Circuit Court of Appeals, which reversed and remanded the case. EEOC v. Warfield-Rohr Casket Co., 364 F.3d 160 (4th Cir. 2004). After a four day trial the jury returned a verdict for the plaintiff, in March 2005, in the amount of $397,948.75 plus a 3.2% annual interest rate. During the trial both parties moved for two judgments as a matter of law each, and after the jury verdict the defendant moved for yet another judgment as a matter of law, and was denied. The EEOC also moved for equitable relief after the trial in the form of an injunction preventing the defendant from discriminating on the basis of age and requiring a posting of notice, both of which were granted.
