In September 2006, the Los Angeles District Office of the EEOC filed this lawsuit against the construction cement supplier Robertsons Ready Mix LLC in the U.S. District Court for the Central District of California alleging discrimination on the basis of gender, female, in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact claims involved are unknown. However, it appears from the consent decree that the defendant allegedly failed to hire female drivers for its cement mixers. Prior to the defendant making an appearance in court, the parties settled the lawsuit in April 2007 through a consent decree.

The three-year decree, containing an agreement not to discriminate or retaliate, required the defendant to: make compliance reports, keep records, hire an internal manager/EEO monitor, allow qualified claimants to reapply for the job position, utilize objective job descriptions and hiring criteria, post and distribute notice of employee rights, provide employee training, and pay $550,000 to be distributed among a class of individuals at the EEOC's sole discretion. The docket sheet shows no further enforcement, so the case was presumably closed in 2010.

CONSENT DECREE; ORDER by Judge Christina A. Snyder: The provisions and agreements contained in the Consent Decree are effective immediately upon the date which this Decree is entered by the Court. The duration of this Consent Decree shall be three years from the date of the Effective Date. In settlement of this lawsuit, Defendant Robertsons Ready Mix, Ltd.'s ("Robertson's") shall pay a total of $550,000 to be designated as a "Class Fund" to resolve this action. The designation of who is a Qualified Claimant and allocation of the Class Fund to the Qualified Claimants shall be made at the sole discretion of the EEOC as determined pursuant to subsection D. in this document. Robertson's shall hire a Claims Administrator, whose duty shall be to administer and effect distribution of sums specified herein to persons determined to be Qualified Claimants who have completed and complied with the Notice and Claims Process, all as set forth in the Decree, in accordance with the written specifications of the EEOC. Robertson's shall bear all costs associated with the implementation of its obligations under this Decree, including the administration of the monetary claims, monitoring, and the mediation.
