On August 31, 2015, a group of minority New York City police officers who had been disciplined or fired filed a class action suit against the New York City Police Department (“NYPD”) in the U.S. District Court for the Southern District of New York for violations of the First, Fifth, and Fourteenth Amendments, as well as violations of the Civil Rights Act of 1866, and of 42 USC §§ 1981, 1983, 1985. The plaintiffs sought declaratory and injunctive relief and compensatory damages. Specifically, the plaintiffs claimed that the NYPD's system of traffic violation quotas led to unconstitutional and racially discriminatory stops and frisks. The plaintiffs also alleged that officers who raised concerns about these issues, including through testifying in a class action lawsuit against the NYPD, experienced workforce retaliation with disparate treatment and impact on minority police officers. The case was presided over by Judge Laura Taylor Swain.

On December 10, 2015, the plaintiffs filed an amended complaint. On January 11, 2016, the NYPD moved to dismiss the amended complaint, asserting that the complaint failed to properly state the claims alleged. On March 6, 2017, Judge Laura Taylor Swain granted the NYPD's motion to dismiss, but allowed the plaintiffs to make a motion for leave to replead the claims and requests for relief. 2017 WL 892350. On May 14, 2017, the plaintiffs filed a memorandum of law in support of their motion for leave to file a second amended complaint. On June 27, 2018, the plaintiffs’ motion to amend their complaint was granted and denied in part. Each plaintiff’s claims were reviewed individually. The court allowed individual plaintiffs’ federal discrimination claims against various individual defendants, various plaintiffs’ retaliation claims, all plaintiffs’ state law claims, all plaintiffs’ First Amendment retaliation claims against one individual defendant, and various plaintiffs’ First Amendment retaliation claims against the City and additional individual defendants. 317 F.Supp.3d 746.

On July 18, 2018, the plaintiffs submitted an amended complaint that abided by the District Court’s ruling. On October 2, 2019, the case was reassigned to Magistrate Judge Sarah L. Cave. After multiple discovery deadline extensions, with the final deadline being January 10, 2020, the parties were required to submit a joint status report and they began settlement conferences and scheduled a settlement conference for December 4, 2019. The parties did not settle. On March 5, 2020, the court issued a motion to compel the defendants to provide discovery materials. Magistrate Judge Cave also issued sanctions against the defendants for spoliation. 2020 WL 3439341. The court further found that the plaintiffs were entitled to an inference that there was a likelihood that destroyed evidence would have supported claims of adverse employment action and retaliation. 2020 WL 1067482. The defendants’ request for reconsideration was denied by Magistrate Judge Cave. 2020 WL 1847556. Judge Swain affirmed. 2020 WL 3619014. An additional motion for sanctions against the defendants was denied. 2020 WL 7055572. The defendants later moved to preclude use of the negative inference regarding spoliation at trial but their request was denied on October 21, 2022. 2022 WL 13826120.

The defendants filed a motion for summary judgment on May 17, 2021, and the court stayed litigation pending its decision on that motion. On July 7, 2022, Judge Swain granted in part and denied in part the defendants’ motion for summary judgment. The case was allowed to proceed for two officers’ First Amendment retaliation claims and the court dismissed without prejudice discrimination and retaliation claims based on state and local law. 2022 WL 2529547.

The plaintiffs requested leave to file a third amended complaint after the defendants disclosed, after the close of discovery, additional personnel documents relevant to one of the plaintiff’s claims. Magistrate Judge Cave heard oral argument on the issue and submitted a report and recommendations to Judge Swain on December 2, 2022.

On July 26, 2023, the court adopted the magistrate judge’s October 21, 2022 report in its entirety. 2023 WL 4760579. 

As of January 12, 2024, this case was ongoing.
