On August 12, 2020, a female employee sued Chipotle Mexican Grill, Inc. in the United States District Court for the District of Arizona. The lawsuit followed an Equal Employment Opportunity Commission determination finding reasonable cause to believe that Chipotle had violated Title VII. In the complaint, the plaintiff alleged that Chipotle discriminated against her by refusing to provide adequate break time to pump breast milk while on shift, in violation of Title VII of the Civil Rights Act of 1964 42 U.S.C. § 2000e. Represented by private counsel, the plaintiff sought back pay, front pay, compensatory and punitive damages, and attorneys' fees, and initially sought class certification. The case was assigned to Judge Steven P. Logan.
According to the complaint, on December 29, 2016, the plaintiff requested a break to pump breast milk, but her managers refused, stating that the restaurant was too busy. The complaint alleged that the plaintiff’s breasts began visibly leaking through her shirt while she was required to continue serving customers. After noticing that she was leaking, the managers allegedly told her she could take a break in fifteen minutes. The complaint further alleged that during this time, she was required to continue interacting with customers in her soaked shirt, and that approximately forty minutes after she was finally allowed to pump, her managers called her into the office and berated her.
On August 14, 2020, Judge Logan issued a preliminary order stating that any motion to dismiss the case would be discouraged if the pleading could be cured by filing an amended pleading. On September 1, 2020, the plaintiff filed an amended complaint. The amended complaint was largely identical to the original, except that the plaintiff was now suing individually, with no class-action allegations. Accordingly, the scope of relief was amended to eliminate relief to other individuals similarly situated. There was no additional information from the pleadings as to why the class allegations were dropped.
On July 13, 2021, the parties reported to the court that they were engaging in settlement talks. Shortly after, on July 27, the case was dismissed. The terms of the settlement were not publicly disclosed.
