The U.S. Equal Employment Opportunity Commission (EEOC) filed the suit on April 6, 2023, in the U.S. District Court for the District of Nevada on behalf of a class of employees of the Downtown Grand Hotel & Casino. The complaint (2023 WL 9118832) alleged violations of Title VII of the Civil Rights Act of 1964, Title I of the Americans with Disabilities Act, and Title I of the Civil Rights Act of 1991. Plaintiff sought a permanent injunction against discriminatory practices, an order to provide equal employment opportunities, and compensatory and punitive damages.

The case was assigned to Judge Andrew P. Gordon (after Judge James C. Mahan recused himself).

The case was stayed several times while the parties entered mediation. On April 23, 2024, the parties filed a consent decree to settle the case. The decree included a 3-year injunction to ensure a workplace free from discrimination and retaliation (including training managers and providing a mechanism for handling reasonable accommodation requests); an EEOC monitor; and monetary relief of $720,000 to be distributed to the affected employees at the discretion of the EEOC. As of February 2025, the injunction was ongoing.
