This case is about Amazon’s alleged practice of discriminatory pay based on gender. On November 20, 2023, three female Amazon employees filed this lawsuit in the U.S. District Court for the Western District of Washington; the case was assigned to Judge Jamal N. Whitehead. The employees sued their employer, Amazon, under various state gender discrimination and equal pay laws, as well as under the federal Equal Pay Act (29 U.S.C. § 206). Represented by private counsel, the employees sought class action certification so that similarly discriminated employees could join their lawsuit, trial by jury, back pay, various damages, service payments to representatives of the class, attorneys fees, and any other relief deemed proper.  

The employees claimed that Amazon—which uses a tiered job code system to determine compensation, bonuses, and other benefits—regularly assigns women to lower job codes than similarly qualified men. The employees further claim that Amazon fails to advance women to higher job codes, resulting in less pay for similar work. They also claim that, even within job codes, Amazon pays women lower wages than men. Finally, the employees allege that they were demoted within weeks of reporting this suspected gender discrimination to their bosses and to Amazon’s HR department. 

As of January 2, 2024, Amazon had yet to respond to the complaint. The case is ongoing.
