Case Summary

In July 2005, the Miami District Office of the EEOC brought this action against Stock Building Supply, d/b/a Stuart Lumber Co., in the U.S. District Court for the Middle District of Florida. In its complaint, the EEOC alleged that the defendant violated both Title VII of the Civil Rights Act of 1964 and Title I of the Civil Rights Act of 1991 by discriminating against the charging party, a black employee, because of his race. In particular, the defendant promoted the charging party to a position that included increased responsibilities without ever paying him the increased salary generally associated with his new position. The parties participated in discovery and an unsuccessful formal mediation process before settling the case through a consent decree in March 2007. The consent degree contained several requirements. Stock was required to: develop a written policy of compliance with Title VII, provide EEOC-approved Title VII training to its managers and supervisors, retain records involving any complaints of race discrimination, and report to the EEOC at specified intervals. Stock also agreed to pay $60,000 to the charging party. The decree was to last for 18 months. The docket sheet doesn't show any further enforcement took place; the case was presumably closed in 2008.
