Case Summary

The Memphis office of the EEOC brought this action in the U.S. District Court for the Eastern District of Arkansas, against Jayco Acquisition and Holding Company, Inc., d/b/a Compton's Oak Grove Lodge Inc. The complaint, filed in July 1998, alleged age discrimination in violation of the Age Discrimination in Employment Act of 1967. Specifically, the complaint alleged that the charging party was discharged because of her age (71).

Defendant moved to dismiss the case in August 1998, but the motion was denied in October 1998. In May 1999 the parties settled and agreed to a consent decree. The decree, which was good for 18 months, included non-discrimination and non-retaliation provisions, as well as a requirement that Defendant post a notice concerning the decree for one year. Defendant was also required to pay the charging party a total of $20,000 in back pay and liquidated damages.
