The Charlotte District Office of the EEOC brought this action in the U.S. District Court for the Western District of North Carolina, against Quality Sprinkler Company, Inc. The complaint, filed in September 2001, alleged race discrimination in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the Defendant subjected the charging party to a hostile work environment based on his race (black), including derogatory comments, name-calling and physical abuse.
In February 2003, a consent decree was entered. The decree, valid for three years, prohibited the Defendant from discriminating or retaliating against employees, provided for the Defendant to pay a total of $40,350 to the charging party; required Defendant to maintain an anti-harassment policy and distribute said policy to all employees, provide Title VII training to all managers and supervisors; and post a non-discrimination notice. Defendant was required to provide the EEOC with semi-annual reports concerning compliance for the duration of the decree, and the EEOC was allowed to monitor Defendant's compliance with the decree.
