In September 2002, the EEOC district office in San Antonio, Texas brought this action against Auto-Gas Systems, Inc. in the U.S. District Court for the Western District of Texas. Although the complaint is not available, the consent decree states that a black female former employee alleged that the defendant violated Title VII of the Civil Rights Act of 1964 by discharging her because of her race and her gender. After the case was reassigned to another judge, the parties settled and a consent decree was entered in June 2003.
In the consent decree, the parties agreed that the defendant would post and distribute an "intent not to discriminate" policy, audit its current anti-discrimination policy to meed EEOC specifications, pay the former employee $25,000, issue neutral references, have all Braunfels facility employees review materials explaining why it is illegal to treat an employee unequally because of race and/or gender, provide EEO training, and allow the EEOC to ensure its compliance through inspections. No fees or costs were awarded. The terms of the agreement ran for three years.
