LETTER dated 4/27/04 from Kam Wong to Judge Spatt Re: In response to the Court's Notice regarding why an order should not be entered dismissing EEOC's action against John Harvard's Brew House. On 12/22/03, the parties agreed on the terms of a Consent Decree to submit to the Court for approval. The only outstanding issue has been dft's need to identify an appropriate anti-discrimination on-line training for EEOC's review and approval, which will then be incorporated into the terms of the Decree. EEOC requests that the Court not dismiss its Complaint, and that a telephonic conference with either your Honor of Magistrate Judge Wall be set in two weeks time regarding finalization of this training issue. CONSENT DECREE - In settlement of this action, Dft shall pay a total of $145,000.00 to Charging Party Jennifer James. No part of this money shall be spent on the costs of implementing this Decree or for any other injunctive relief put forth in this Decree. This payment is to be made within twelve business days of the entry of this Consent Decree. The parties agree that this Court has jurisdiction over the subject matter of this action and the parties for the duration of this Decree, that venue is proper, and that all administrative prerequisites have been met for purposes of entering and enforcing this Decree.
