The Seattle Office of the EEOC brought this suit against Tele-Servicing Innovations, Inc. in June 2003 in the United States District Court for the District of Idaho. The complaint alleged that Tele-Servicing intentionally terminated the complainant in retaliation for her participation in protected EEO activity, including the filing of internal complaints of sexual harassment, in violation of Title VII of the Civil Rights Act of 1964. The complainant intervened alleging gender discrimination, sexual harassment and a hostile work environment, and retaliation in violation of Title VII and Idaho Human Rights Act. She also alleged breach of employment contract, breach of covenant of good faith, and negligent or intentional infliction of emotional distress. After the defendant failed to answer the complaint, the intervenor-plaintiff and the EEOC moved for entry of default against Tele-Servicing in October and November 2003 respectively. Default judgment against Tele-Servicing was awarded to the plaintiffs in June 2004.
The default judgment awarded a total of $208,833 to the plaintiffs. The intervenor-plaintiff was awarded $8,240 in back pay plus $593 in pre-judgment interest, $125,000 in compensatory damages and $75,000 in punitive damages. The court permanently enjoined Tele-Servicing from engaging in any employment practice constituting retaliation based on a person engaging in EEO activity.
