In June 2004, the New Orleans District Office of the EEOC brought this lawsuit against Noble Drilling Inc. in the Eastern District of Louisiana alleging discrimination on the basis of race and retaliation in violation of Title VII of the Civil Rights Act of 1964. Specifically, the complaint alleged that the defendant oil drilling company exposed complainant, an African-American employee, to a racially hostile work environment and unlawfully retaliated against him by terminating him.

Defendant's motion for dismissal due to improper venue caused the action to be transfered to the U.S. District Court for the Western District of Louisiana in December 2004. Following motions for partial summary judgment by the EEOC and for full summary judgment by the defendant in September 2005, the lawsuit was dismissed by the District Court when it granted defendant's motion for summary judgment in February 2006. The EEOC appealed the ruling to the Fifth Circuit in April 2006, and withdrew its appeal in June 2006.
