EEOC's Dallas, TX office filed this Title VII lawsuit against the defendant Kaspar Wire Works Inc. a/k/a Kaspar Ranch Hand Inc. at the United States District Court for the Northern District of Texas (Dallas). The complaint, filed on 09/17/2001, alleged that the defendant failed to promote an individual complainant because of his Hispanic national origin. EEOC got the defendant wrong throughout the lawsuit and did not have a chance to correct before the case was closed by a summary judgment for the defendant. The correct defendant in the case should have been Kasper Ranch Hand, LLP, which was a related but entirely separate entity from the named defendant.

District Judge Ed Kinkeade granted the defendant's summary judgment motion because the EEOC failed to establish a prima facie case under the McDonnell-Douglas inquiry. EEOC filed a partial summary judgment in the meantime but the motion was denied as moot after the defendant's summary judgment motion was granted. Judge Kinkeade also granted defendant $8,995.38 to recover costs, not including attorney's fees.
