Case Summary

In April 2001, the Richmond Area Office of the EEOC filed this lawsuit against Pentman, LLC, doing business as Arby's of Wise,VA, in the U.S. District Court for the Western District of Virginia. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the Opinion and Order denying the summary judgment motion that the complaint alleged that the defendant subjected the complaining parties, female employees, to a sexually hostile work environment by allowing a female manager to sexually harass them, retaliate when such harassment was opposed, leading to complainants' constructive termination in violation of Title VII of the Civil Rights Act of 1964. Following a failed motion for summary judgment by the defendant in February 2002, the parties settled the lawsuit through a consent decree. We do not have a copy of the consent decree; therefore, the exact terms of the settlement are unknown.
