In May 2004, the Los Angeles District Office of the EEOC brought this suit against Victor-Arch, Inc., d/b/a Archibald's Drive Thru, in the U.S. District Court for the Central District of California. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. According to the consent decree, the defendant discriminated against the three charging parties, female applicants and employees, by denying them employment or continued employment in violation of Title VII of the Civil Rights Act of 1964. After the defendant answered the complaint in September 2004, the parties seemed to have reached a tentative settlement in January 2005. The parties put the final settlement into writing in March 2005 when they entered into a consent decree.
The three-year decree prohibited the defendant from retaliating or discriminating. In addition, it required the defendant to: revise its jobs descriptions, employee handbook, and policies; provide Title VII training for all its employees; post a notice of the decree; report to the EEOC at specified intervals; and pay $13,000 to be divided among the three charging parties. The docket sheet shows that no further enforcement took place; the case was presumably closed in 2008.
