In September 2003, the EEOC district office in Milwaukee, Wisconsin brought this action against STI Holdings, Inc. in the U.S. District Court for the Western District of Wisconsin. Although the complaint is unavailable, the EEOC litigation reports states that the EEOC alleged violations of Title VII of the Civil Rights Act of 1964 based on race and sex. Specifically, the EEOC alleged that the defendant utilized a preemployment test that was biased against Blacks and women. Within one week of the complaint being filed, a consent decree was entered on 6 October 2003. However, over the following eight months, the parties moved several times to change the terms of the decree. In January 2005, the EEOC moved to enforce and extend the decree, but after briefing, the Court denied that motion in March 2005.
The EEOC litigation report and the consent decree states that the parties agreed that the defendant would pay the class a total of $180,000, refrain from using a biased preemployment test, hire at least twenty-seven qualified black applicants when assembler positions became available, and send out notifications of additional positions to interested class members. No fees or costs were awarded. The terms of the decree ran for two years and additionally required the defendant to post notice of rights.
