Case Summary

In July 2003, the Saint Louis District Office of the EEOC filed this lawsuit against Trans States Airlines, Inc., a regional airline service provider, in the U.S. District Court for the Eastern District of Missouri alleging discrimination on the basis of race, religion or national origin in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the EEOC's press release that…

In July 2003, the Saint Louis District Office of the EEOC filed this lawsuit against Trans States Airlines, Inc., a regional airline service provider, in the U.S. District Court for the Eastern District of Missouri alleging discrimination on the basis of race, religion or national origin in violation of Title VII of the Civil Rights Act of 1964. We do not have a copy of the complaint; therefore, the exact allegations involved are unknown. However, it appears from the EEOC's press release that the defendant allegedly fired the complaining party as a pilot based upon an anonymous complaint without verification. The complaining party intervened in the lawsuit in August 2003. The defendants Airline Pilots Association, International (AFL-CIO) were subsequently added to the lawsuit. Following discovery, the defendants successfully moved for summary judgment. Following a number of appeals to the U.S. Court of Appeals for the Eighth Circuit by both parties, the Court of Appeals affirmed the District Court's decision to award summary judgment to the defendant but not attorney's fees. Subsequent petitions for rehearing en banc were likewise denied.
