In June 2001, the Miami District Office of the EEOC filed this suit against Applied Industrial Technologies, Inc. and related businesses in the U.S. District Court for the Middle District of Florida alleging discrimination in violation of the Age Discrimination in Employment Act of 1967 ("ADEA"). Specifically, the defendant discriminated against the two charging parties, well-qualified male employees over the age of forty, by laying them off or terminating them on the basis of their age and replacing them with younger individuals. The parties settled through a consent decree merely two days after the complaint was filed.
The three-year decree, containing a non-discrimination clause, required the defendant to: provide annual ADEA training for its managers in the state of Florida, post an ADEA notice, report to the EEOC on age discrimination complaints annually, and pay $600,000 to establish a claimant fund to settle potential age discrimination claims.
