In December 1997, the Miami District Office of the EEOC filed this claim against Calder Race Course, Inc. in the U.S. District Court for the Southern District of Florida alleging discrimination on the basis of age in violation of the Age Discrimination in Employment Act of 1967. Specifically, the complaint alleged that the defendant discriminated against the four complainants, employees over 65, by firing them from their positions and replacing them with younger and less experienced workers. Following extensive discovery and a referral to mediation, the defendant was granted summary judgment in March 1999. The EEOC appealed to the Court of Appeals for the 11th Circuit in May 1999, which dismissed the case in September 1999.
