This is a case about alleged racial discrimination in employment conditions at the Maryland Department of State Police. The corresponding DOJ investigation, filed three months prior, can be found here.

The plaintiffs, three officers of color employed by the Maryland Department of State Police, filed this putative class action in the U.S. District Court for the District of Maryland on October 24, 2022, on behalf of themselves and similarly situated officers. Represented by private counsel, the plaintiffs sued the Maryland Department of State Police under 42 USC § 1983, alleging that it engaged in discriminatory employment practices in violation of the Fourteenth Amendment by over-disciplining and under-promoting officers of color. Additionally, the plaintiffs asserted that their attempts to raise complaints about their experiences resulted in retaliation in violation of the First Amendment. As such, the plaintiffs sought compensatory damages, injunctive and declaratory relief, and attorneys’ fees. Judge Deborah L. Boardman was initially assigned to the case, but it was later reassigned to Judge Brendan Abell Hurson. 

On August 25, 2023, the case was stayed for 30 days while the parties pursued settlement. The stay was later lifted on September 21 when the parties failed to reach a settlement. The plaintiffs filed an amended complaint on October 16, 2023, which contained six total claims: retaliation and discrimination in violation of Title VII, retaliation and discrimination in violation of state law, retaliation in violation of the First Amendment, and discrimination in violation of the Fourteenth Amendment. The complaint named the state of Maryland as the defendant for the Title VII and state law claims and various individual officers as defendants for the constitutional claims.

The defendants filed a motion to dismiss or, in the alternative, for summary judgment on November 20, 2023. On September 13, 2024, the court granted the motion to dismiss in part and denied it in part. The court dismissed the constitutional claims against the individual defendants because the plaintiffs had not sufficiently connected the specific defendants to the alleged discriminatory actions. However, the court allowed the Title VII and state law claims against the state of Maryland to go forward. 2024 WL 4202444.

As of January 2025, the parties were participating in discovery and the case was ongoing.
