EEOC's Birmingham, AL office filed this sexual harassment lawsuit against Brookley Furniture Company and Howard Miller Clock Company in the United States District Court for the Southern District of Alabama (Southern Division) on 09/28/2004. Brookley Furniture is a Michigan corporation that operates a furniture factory in Mobile, Alabama. Howard Miller has been an integrated enterprise of Brookley Furniture.

EEOC alleged on behalf of an unidentified former female employee that she was subject to repeated sexual harassment from the company's general manager. EEOC withheld the employee's identity to protect her privacy. The employee was forced to resign after her supervisors took no action in response to her complaints. Following the employee's resignation, Brookley Furniture terminated both the general manager and the employee. Accordingly, EEOC made additional claims of constructive discharge and wrongful termination on behalf of the employee. In her intervening complaint, the employee also asserted state-law tort claims.

The parties engaged in 10 months of intensive discovery, during which both sides filed several motions for partial summary judgment and numerous discovery motions. The district court did not resolve any of the summary judgment motions. At the end of discovery and before jury trial, the parties proposed a settlement agreement and the court entered a consent judgment on 01/03/2006.

Under the consent decree, the defendant would pay a total of $225,000 in monetary relief to the employee and provide neutral reference for her. The decree also prohibited the defendant from engaging in sexual discrimination or retaliation in the future.
