EEOC's El Paso, TX office filed this sex discrimination lawsuit against the defendant, El Paso Complete Printing, Inc. in the United States District Court for the Western District of Texas (El Paso)on 03/16/2000. EEOC alleged that a former female employee was disciplined for work rule violations based on her gender at defendant's El Paso, TX facility. EEOC also claimed that the employee was terminated after she protested against defendant's discriminatory policies. The former employee did not intervene in the lawsuit.

The parties settled and proposed consent decree less than a month after EEOC filed a partial summary judgment on 08/11/2000. The district court entered the consent decree and closed the case on 09/13/2000.

The consent decree lasted for 2 years. The defendant was required to pay $40,000 to the former employee. The defendant must also provide neutral reference and expunge the employee's personnel file of anything related to this lawsuit. Additionally, the defendant was enjoined from discriminating based on gender and retaliating against opposition in the future. Specifically, the decree stipulated that the defendant was only prohibited from discriminating against females, not males. The defendant must also post notice of its EEO policies at the El Paso facility for two years and provide no less than 60 hours of training for all supervisory personnel there. The decree required the training to significantly involve attorneys certified in Labor & Employment Law by the Texas Board of Legal Specialization.
